The Petroleum Products Act, 1977 (Act No. 120 of 1977), as amended in 2003 and 2005, governs the sale, storage, and wholesale of petroleum products. Administered by the Department of Mineral Resources and Energy (DMRE), this legislation ensures that no individual or business may operate in the petroleum sector without the appropriate licenses.

  • License Validity: As long as the business continues to operate and complies with licensing requirements.

Retail Petroleum License

  • New Retail Licenses: Required for the sale of petroleum products to consumers.
  • Change of Hands Applications: A new retail license must be obtained when ownership changes, as the license is non-transferable.
  • Amendments to Existing Licenses: For changes to the business structure or operations.
  • Annual License Submissions: Retailers must submit annual compliance documents to maintain their licenses.

  • Ownership Changes: If there is a majority ownership change, a new application must be submitted rather than an amendment.
  • Renewals: License renewals must be submitted one month before expiration. A grace period of two months is allowed post-expiry, with penalties. Failure to renew within this period results in license cancellation.
